Terms of use

The rules for using Dixit. By creating an account, you accept them. They apply to everyone, so that everybody can post and rate without fear.

This is a translation. In case of any discrepancy, the French version prevails.

1. Purpose

These terms of use (the "Terms") govern the use of the Dixit mobile app and the www.dixit-app.com website (together, the "Service"), published by FIBROWEB, a French SAS with a share capital of 1 EUR, registered with the Grasse Trade and Companies Register under number 884 058 702, whose registered office is at 47 Domaine des Roumeguieres, 06460 Saint-Vallier-de-Thiey, France ("Fibroweb" or "we").

Dixit is a social network: you post "drops" (a photo or a video of up to 15 seconds, with a "Rate my…" title) that other users rate from 0 to 10 for 24 hours, with an optional short note. The Service also offers following between accounts, comments, a streak of consecutive days, badges and verification on request.

The Service is free. It has no subscription, no in-app purchases and no advertising.

2. Sign-up and account

• Minimum age: 15. You must be at least 15 to create an account. Your date of birth is requested and checked at sign-up; it is never shown.
• Sign-in: you can only sign up with an Apple or Google account. You are responsible for the security of that account and of your phone.
• Accuracy: the information you provide (date of birth, first name, username) must be accurate and must not mislead other users. An account is personal: it cannot be lent, sold or shared.
• Username: it must not be offensive or misleading, or infringe the rights of others (another person's name, a trademark). It can be changed every 30 days. We may change or remove a username that breaks these rules.
• Private or public accounts: accounts are private by default. You choose who can see and rate your drops and who can comment, and you can change these settings at any time.

3. Community rules

You alone are responsible for what you post (drops, titles, ratings, short notes, comments, profile). The following are strictly prohibited, without exception:

• Nudity and sexual content: nudity, sexual or sexually suggestive content, sexual solicitation.
• Harassment and mockery: insults, humiliation, mocking a person, degrading ratings or comments about someone's body, pile-ons, threats, encouraging harassment, posting a photo of someone to have them rated without their consent.
• Violence: real violence, shocking or gory content, animal cruelty, encouraging self-harm, suicide or dangerous challenges.
• Hate: hateful or discriminatory speech or symbols based on origin, religion, sex, sexual orientation, gender identity, disability or any other protected characteristic.
• Minors: any content that sexualizes, exploits or endangers a minor. Such content is reported to the authorities.
• Scams and spam: fraud, phishing, unwanted advertising or commercial solicitation, misleading links, fake accounts, rating manipulation (multiple accounts, organized rating swaps).
• Impersonation: pretending to be another person, a brand or an organization.
• Illegal content: glorifying terrorism, selling drugs, weapons or prohibited products, counterfeiting, violating the privacy or image rights of others, sharing another person's personal data, and more generally any content that breaks French law.

It is also prohibited to disrupt the Service: bypassing security or blocking measures, automatically collecting other users' data, using bots, or trying to access accounts or content without authorization.

4. Ratings and short notes

Ratings are given in good faith: they reflect your honest opinion of the drop, not a person's worth. Be frank without being hurtful. A rating or short note used to harass, humiliate or mock is a breach of the rules above. A drop's author can see who rated it. Ratings, averages, streaks and badges have no monetary value.

5. Reporting and blocking

In the app, you can at any time:

• report a drop, an account or a comment ("…" menu, then Report); the reported person does not know who reported them;
• block an account: it can no longer see your profile or your drops, follow you or interact with you, and you no longer see its content;
• mute an account, restrict its comments, and filter words in comments under your drops.

You can also report content by writing to hello@dixit-app.com. If you are in immediate danger, contact emergency services (112 across the EU, 17 for the police in France). In France, 3018 (a free, anonymous and confidential helpline) supports victims of online harassment.

6. Moderation

• Every report is reviewed by the team within 24 hours.
• Any content that breaks the Terms or the law is removed. Depending on how serious it is, its author receives a warning, has their account temporarily suspended or is permanently banned, without notice in serious cases (sexual content involving a minor, threats, hate, scams).
• We may also act without a report when we notice a breach, and we report clearly illegal content to the competent authorities (notably through the French PHAROS platform).
• When we remove content or suspend an account, we tell you why. You can appeal the decision by writing to hello@dixit-app.com within 6 months; the appeal is reviewed by a member of the team.

7. Your content and the license you grant us

You keep ownership of the content you post. So that the Service can work, you grant Fibroweb a non-exclusive, royalty-free, worldwide and limited license to host, reproduce, technically adapt (resize, re-encode, remove metadata) and display your content within the Service, to the people allowed by your settings. This license is only used to run the Service: we do not use your content for advertising and we do not sell it.

The license ends when you delete the content or your account, once the copies have been erased from our servers (within 30 days at most). It does not extend to copies other users may have made by their own means (screenshots), which we cannot control.

You confirm that you hold the necessary rights over what you post, in particular the consent of people who can be recognized in your photos and videos, and rights to any music or works that appear in them.

8. Verification

An account can apply for verification from the app once it meets the conditions shown (public account, complete profile, minimum number of followers and drops). Verification is granted at Fibroweb's discretion, free of charge, and may be refused or withdrawn, in particular in case of a breach of the Terms or impersonation. It indicates that an account is authentic and notable, not that Fibroweb endorses its content.

9. Dixit's intellectual property

The Dixit name, logo, the design of the app and website, their texts and their code belong to Fibroweb or its partners and are protected. You receive a personal, non-exclusive and non-transferable right to use the app for private purposes, in accordance with the Terms. Any unauthorized reproduction or extraction is prohibited.

10. Liability

• Fibroweb hosts the content posted by users and is not its author. As required by law, we act promptly to remove illegal content as soon as we become aware of it.
• We do our best to keep the Service available and working properly, but cannot guarantee it at all times (maintenance, outages, force majeure). Features may change.
• You are responsible for how you use the Service and for the content you post, and you agree to indemnify Fibroweb against any third-party claim related to your content.
• Nothing in the Terms limits the rights you have by law as a consumer, or our liability for gross negligence or willful misconduct.

11. Suspension, termination and account deletion

You can delete your account at any time from the app (Me > Settings > Account > Delete my account) or by email. It is hidden immediately and permanently erased within 30 days; during that period, you can cancel the deletion by signing in again. All the details are on the Delete my account page. You can also temporarily deactivate your account: it comes back as soon as you sign in again.

Fibroweb may suspend or close an account that breaks the Terms or the law, as described in section 6. We may also discontinue the Service by giving you at least 30 days' notice, so you have time to download your data.

13. Apps downloaded from the App Store

The Terms are concluded between you and Fibroweb, not with Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of the Terms and may enforce them against you. The same principles apply to Google for the app downloaded from Google Play.

14. Changes to the Terms

We may change the Terms to reflect changes to the Service or the law. If there is a significant change, we will let you know in the app at least 15 days before it takes effect, unless the law requires a shorter period. If you do not accept the new Terms, you can delete your account; continuing to use the Service means you accept them.

15. Governing law and disputes

The Terms are governed by French law. If there is a problem, please write to us first at hello@dixit-app.com: we always look for an amicable solution. Failing that, the dispute will be brought before the competent French courts; if you are a consumer, you may also go to the courts where you live and you keep the protection of the mandatory rules of your country of residence.

The Terms are available in French, English and Spanish; in case of any discrepancy, the French version prevails.
